Pre-foreclosure · By Travis DeLoach

Pre-foreclosure in Mississippi: your options, and how to stop the clock

Missing mortgage payments is stressful, and the letters get scarier each month. The most important thing to know: the earlier you act, the more options you have.

What does pre-foreclosure mean?

Pre-foreclosure is the period after you fall behind on your mortgage but before the home is sold at a foreclosure sale. You still own the home, and you can still sell it, refinance or work something out with the lender.

How long does pre-foreclosure last in Mississippi?

Under federal rules, most mortgage servicers can't start a foreclosure until you're more than 120 days behind. Most Mississippi foreclosures are non-judicial, meaning they go through a power of sale in the deed of trust rather than a court case, so things can move quickly once they start.

Mississippi law requires the sale to be advertised in a local newspaper for three consecutive weeks before it happens. After a non-judicial sale, Mississippi generally doesn't give owners a right to buy the home back, so the time before the sale is what counts.

Option 1: A short sale

If you owe more than the home is worth, a short sale may be the strongest option. The lender agrees to accept less than the loan balance, the home is sold, and the foreclosure is avoided. Once a complete short sale package is in, many servicers will review it before moving ahead with a sale, which can buy time.

A short sale is usually easier on your credit than a foreclosure, and you can ask the lender to waive the remaining balance. Travis's full short sale guide covers how it works.

Option 2: Sell before the sale date

If you have equity, selling, either to a cash buyer or through a fast listing, can pay off the loan and put the remaining money in your pocket instead of losing it at auction.

Option 3: A novation

If there's equity but the house needs work, a novation lets an investor fund repairs and sell to a retail buyer while you pay off the loan from the proceeds. It needs time, so it works best when the foreclosure date is still months away.

Option 4: Subject-to

In a subject-to sale, a buyer takes over the home and makes the mortgage payments while the loan stays in your name. It can catch up missed payments and stop the foreclosure, but it carries real risk: your credit stays tied to the loan, and most mortgages have a due-on-sale clause that lets the lender demand full payment. Only consider it with a written agreement, an attorney and a buyer you trust.

Option 5: Work it out with the lender

Ask your servicer about a repayment plan, forbearance or loan modification. A HUD-approved housing counselor can help at no cost. These keep you in the home if your income can support the payment.

How Travis helps you deal with the bank

Talking to a lender while you're behind is hard. Travis can help you gather the paperwork, communicate with the lender on the sale side, and push a short sale or sale through on a deadline. Because he's both a licensed agent and an investor, he can compare a short sale, a cash offer and a novation for your situation, and he'll tell you when to bring in a foreclosure attorney or housing counselor.

Frequently asked questions

What is pre-foreclosure?+

It's the time after you fall behind on your mortgage and before the foreclosure sale. You still own the home and can sell, refinance or negotiate.

How long is the pre-foreclosure process in Mississippi?+

Servicers generally can't begin foreclosure until you're more than 120 days behind. After that, a non-judicial sale needs three weeks of newspaper notices, so it can move quickly.

Can I sell my house in pre-foreclosure?+

Yes. You can sell any time before the foreclosure sale. If you owe more than it's worth, you'll need the lender's approval through a short sale.

Can a short sale stop a foreclosure?+

It often can. Many servicers will review a complete short sale package before moving ahead with a sale, but get the sale date postponement confirmed in writing.

Is a short sale better than foreclosure?+

For most people, yes. A short sale is generally easier on your credit and lets you ask the lender to waive the remaining balance.

What is a subject-to sale?+

A buyer takes over your payments while the loan stays in your name. It can stop a foreclosure but carries risk, so use an attorney.

Can I get my house back after foreclosure in Mississippi?+

Generally not after a non-judicial sale. That's why acting during pre-foreclosure matters most.

Who should I call first?+

Call your servicer and a HUD-approved housing counselor, and talk with Travis about your sale options. An attorney can advise on the legal side.
